The government’s property sale reforms- major homebuying overhaul - lloyd & whyte legal indemnities

Announced on 6 October 2025, the UK Government is introducing a series of significant reforms to modernise the residential property-selling process in England and Wales. Aimed at increasing transparency, speeding up transactions, and reducing the high rate of fall-throughs, these changes focus on mandatory upfront information, earlier legally binding commitments, and the greater use of digital tools to streamline the journey from listing to completion.

Amongst other things, sellers (and estate agents) would be obliged to make available upfront search and survey information, condition disclosures, leasehold costs, flood risk, etc., before listing a property.

The government hopes this will enable buyers to see the physical condition, characteristics, and flood risk of the property online. Accordingly, it is further hoped it will enable buyers to make informed decisions sooner and sellers will benefit from faster transactions, resulting in fewer costly fall-throughs.

Whether the proposed new obligations on sellers will help highlight earlier and/or additional risks to home-buyers is not certain, but known and unknown risks are likely to remain. Therefore, in this evolving landscape, understanding where and how legal indemnity insurance cover can assist will be crucial for smooth, secure property transactions.

This is where a knowledgeable insurance specialist becomes even more valuable. As transactions evolve and risks become more nuanced, experienced professionals can identify gaps early, interpret the legal implications of disclosures, and recommend bespoke indemnity solutions that fit the specific circumstances of each property. Their expertise ensures that buyers, sellers, and lenders remain protected against unexpected legal or title complications — even in a faster, more transparent market.

This is why working with experienced legal indemnity professionals like Lloyd & Whyte Legal Indemnities is essential. We can navigate evolving regulations, assess risks accurately, and ensure your transactions stay protected and on track.
